United States Court of Appeals Issues Decision in Touro College of Dental Medicine Case
The United States Court of Appeals for the Second Judicial District (Connecticut, New York, and Vermont) has issued a decision in Yodice v. Touro College and University System that held that a dental student in the Touro College of Dental Medicine had stated a viable claim for breach of contract for tuition costs where Touro College of Dental Medicine went to remote learning during the novel coronavirus (COVID-19) pandemic, as well as a viable claim under the New York State General Business Law for alleged deceptive practices and false advertising regarding Touro's marketing tactics with respect to in-person instruction, services, and opportunities enrolled students would receive. The case was remanded to the lower federal court to address these particular claims.
