New York State Appellate Division Third Department Dismisses Dental Malpractice Case
The Appellate Division, Third Department, of the New York State Supreme Court has dismissed a dental malpractice case, Ferrara-Carpenter v. Ormsby, on statute of limitations grounds. The case is interesting for its discussion of why the continuous treatment doctrine did not apply to the case and why the doctrine of equitable estoppel could not be used to prohibit a statute of limitations defense by the dentist.
